Adventure Giveaway Competition

Participation in the Adventure Giveaway Competition ("the Promotion") is deemed acceptance of these Terms and Conditions.

The Promoter of this Promotion is Tourism Whitsundays ltd. (ABN 23 574 179 504), trading as Tourism Whitsundays ("the Promoter").

Employees of the Promoter, Tourism Whitsundays Ltd., and any of its subsidiaries or agencies involved in the Promotion are not eligible to enter. However, immediate family members of such employees are eligible to participate, given that the selection process for the prize is conducted through a random draw, thereby ensuring equitable chances for all participants.

Who can enter?

Entry is only available to Australian residents aged 18+ years at the time of entry.

How to enter?

The Promotion opens for entry on Monday, 10 June 2024, and closes on Friday, 21 June 2024.

To enter, participants must:

• Follow @adventureairlie and @whitsundaysqld on Instagram.
• Share this promotion to their Instagram story.

The entrant must comply with the terms and conditions of the boat they select.

Prizes

Each prize package grants the winner a single spot on their selected boat from the available options. This entitlement strictly includes the boat trip itself and excludes all ancillary costs including flights and additional accomodation. Winners are solely responsible for all additional expenses, including but not limited to, transportation to and from the departure location, meals, accommodations, and any other personal expenses. No additional services or expenses beyond the boat trip are covered under this prize.

Eligibility to select certain boats as part of the prize package is contingent upon the age of the participant and is subject to the specific operating requirements of the boat operator. The Promoter reserves the right to modify the availability of any boat options based on the aforementioned criteria without prior notice.

Travel associated with the prize must be scheduled between June 10 and August 31. All travel is subject to availability and must be confirmed with the respective service providers. The Promoter is not responsible for the unavailability of preferred travel dates or changes in the schedule imposed by the service providers.

The draw

The draw will take place on Friday, 21 June 2024. The winner will be notified via the @adventureairlie Instagram page on Monday, 24 June.

The winners

The winning entrant has 48 hours from the time and date of the notification to respond and claim the relevant prize. If the prize is not claimed within this time frame, it will be redrawn, and any previous winners will forfeit claims to the prize.

The Promoter’s decision is final, and no correspondence will be entered into.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and age) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.

Entrants agree to release, indemnify, and hold harmless the Promoter, its agencies, and employees from any claims, damages, or losses incurred as a result of or in connection with their participation in the Promotion or their acceptance and use of any prize.

The Promoter is committed to protecting the privacy of participants. Personal information collected in connection with this Promotion will be used primarily for the purpose of administering the Promotion, including notifying winners and awarding prizes. Personal data may also be used for future promotional, marketing, and publicity purposes in any media without further reference, payment, or other compensation. Participants' information will not be disclosed to third parties except as necessary for the fulfillment of the Promotion, or as required by law.

This Promotion is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc., or its subsidiaries, including Instagram. All information provided by participants is being provided to the Promoter and not to Meta Platforms, Inc.

This Promotion complies with all applicable laws and regulations, including but not limited to advertising standards and consumer protection laws. The Promoter pledges to conduct this Promotion in a fair and transparent manner, ensuring all participants have an equal opportunity to win.

In case of any interference or if the Promotion cannot be conducted as planned due to any reason beyond the Promoter’s reasonable control, the Promoter reserves the right to modify, suspend, terminate or cancel the Promotion as appropriate, subject to any written directions from a regulatory authority.

Except for liability that cannot be excluded by law, the Promoter (including its officers, employees, and agents) excludes all liability for any loss or damage arising in any way out of the Promotion, whether direct, indirect, special or consequential, including but not limited to, liability arising from technical difficulties or equipment malfunction, or any theft, unauthorized access or third party interference.

It is a condition of accepting the prize that the winner consents to the Promoter using their name, likeness, image, and voice (including photograph, film, and recording) in any media for an unlimited period without remuneration to promote this Promotion and any other promotions, products, or services distributed and supplied by the Promoter.
